1st May 1862  - lease began  -  for some reason the surrender did not take place till the  next year

1) THE LEASE

7th oct 1863  Copyholder created the lease for the plot of land

            George Frederick Ashton of  Stormer Hill within Tottington Lower End,

THE LESSEE – HENRY HORN

Initially   HORN , later spelt  HORNE

 Henry Horn of Ramsbottom, powerloom overlooker.

 

Annual rent of £3.00 sterling    Henry Horn pays to Ashtons

Yearly rent  2 halves   1st May  , 1st Oct   

 

7th Oct 1863 Surrender took place out of court (not at the twice yearly court meetings)

 

DESCRIPTION

All that piece of land in Ramsbottom, bounded on

northerly side,               by land intended to be leased to Alice Smith - 71ft 10”

southerly side                by a road or way from Crow Lane to other land of the lessors

 73’ 10” in length

easterly side                 “by and extending 9’ in breadth into an intended street”    25’ 9”

westerly side                 “by and extending 12’ into Crow lane   36’ 2”

 

total area = 250 sq yrds  “which spaces of 9’ and 12’ were intended to form parts of the said intended street and Crow lane ….. and were at all times thereafter to remain open, unbuilt upon and unobstructed”

 

Also those two cottages or dwelling houses and all other erections and buildings .

Yearly rent 1d    to Lord of  Manor  Duke of Buccleuch & Queensberry

  The new lessee becomes responsible for the  1d  (ie copyholder would have paid this to Buccleuh)

Henry Horne will

1) maintain present and future buildings on the land. “ in such manner that there shall …be buildings of the clear yearly value of £6.00”

2) not to permit any encroachment with cellars or other steps or in any other manner upon the intended street of Crow lane”

 

Rights of repossession   if there are  rent arrears of 30 days

Lessors can re-enter or repossess

  Ashtons make a declaration “they had good right to surrender “   “notwithstanding anything by them respectively or by any of their ancestors done … or omitted to the contrary

1879 - Death of Henry Horn

18 / 4 / 1923     PETER ARMSTRONG  ADMITTED AS TENANT FOR  2 & 4 CROW LANE

After the death of  Mrs E. J Armstrong   2nd Aug 1922 

Her estate passed to her 4 children (or their survivors) the oldest of which was Peter Armstrong

At the Manor Court of the Clitheroe Estate Company Limited of their Manor of Tottington in the County of Lancaster, it was agreed that  Peter Armstrong should be  admitted  tenant of copyhold for No’s 2 & 4 Crow Lane for the residue of a term of 999 years.

 to Peter Armstrong, who owned the 4th share

ELIZABETH JANET ARMSTRONG   Died  2nd Aug 1922 

 

Her estate passed to her 4 children (or their survivors) one of which was Peter Armstrong

The other three beneficiaries sold their shares to Peter Armstrong for £125 per share.

He therefore became the sole owner of  2 & 4 Crow lane

ELIZABETH JANET ARMSTRONG  late of Crow lane,

Widow,

Possessor of the leasehold  2 & 4 Crow Lane

Died  2nd Aug 1922  intestate,

Left 4 children 

      Peter Armstrong, Eveline Ellen Heys, William Armstrong & John Wood Armstrong

             William Armstrong died on 5th Feb 1923 .

His widow was Annie Elizabeth Armstrong

Eveline Ellen Heys died on 23rd July 1939. Her executors are noted above

 

Probate granted to Peter Armstrong on 14th Dec 1922 – administrator of the will

All the expenses and duties had been paid but the property had not been sold.

 

 

SALE OF SHARES TO PETER ARMSTRONG

The following agreed to sell their inheritance

“As personal representative of the said Elizabeth Janet Armstrong deceased

 assent to the vesting in myself of  all the property described in the schedule”

Gift of No 4  from Peter Armstrong to Frederick Yarrow

Peter Armstrong of 2 Crow lane,  retired engineer

Frederick Yarrow of 4 Crow lane, plumber,

“ … in recognition and appreciation given and shown to the donor (Peter Armstrong) by the donee (Frederick Yarrow) for a long time past and in consideration of the promise made by the donee that he and his wife will in future during the life of the donor render appropriate services in the care and attention which may be required by the donor the donor is desirous of assigning the property hereby assigned to the donee in manner hereinafter appearing by way of a gift”  The gift was “all that messuage or dwellinghouse numbered 4 Crow lane with the outbuildings belonging to it and the land forming the site.

The £3.0.0d rent was apportioned between the 2 properties .
